There has previously been some uncertainty over whether hand pallet trucks, also known as manual pallet trucks, fall under the Lifting Operations and Lifting Equipment Regulations 1998, commonly known as LOLER.
The confusion followed the publication of the fourth edition of the LOLER Approved Code of Practice in 2014, which referred to hand pallet trucks that were able to raise their forks.
The Health and Safety Executive has since clarified how these trucks should be treated.
In most cases, standard hand pallet trucks are not covered by LOLER.
Their main purpose is to move palletised loads around the workplace rather than to lift loads to height. Although the forks raise slightly to allow the pallet to be transported, the lifting movement is limited.
Hand pallet trucks that raise their forks no more than 300mm are therefore generally covered by the Provision and Use of Work Equipment Regulations 1998, known as PUWER.
PUWER requires work equipment to be:
Suitable for its intended use
Maintained in a safe condition
Inspected where necessary
Used by people who have received appropriate information, instruction and training
LOLER applies to high lift pallet trucks, whether manual or powered, that can raise their forks above 300mm.
These trucks perform a more significant lifting function and are therefore treated as lifting equipment under LOLER.
Where LOLER applies, the equipment must be suitable and stable, clearly marked where required and subject to thorough examination by a competent person at the appropriate intervals.
Dutyholders should first confirm the type of pallet truck being used and its maximum lifting height.
They should then ensure that:
Standard hand pallet trucks are maintained and inspected in accordance with PUWER
High lift pallet trucks capable of lifting above 300mm are managed in accordance with both LOLER and PUWER
Operators receive appropriate instruction and training
The equipment is suitable for the load, environment and ground conditions
Defects are reported and addressed promptly
A thorough examination under LOLER is not a replacement for routine inspection, servicing or maintenance.
